Description of Practice
Paul’s experience litigating all manner of employment disputes on behalf of employees, employers and other stakeholders provides him with unique perspectives to achieve resolution of your dispute. Whether wage and hour (overtime, independent contractor, prevailing wage, interns, commissions), discrimination, harassment or whistleblower claims, his background and training as a mediator can help parties and counsel bring a negotiated end to what can be emotional, expensive and hard fought litigation. Recognized as a leader in employment law (Lawyer of the Year – Employment Law, U.S. News & World Report, 2016), he has published and lectured extensively and served on the Board of Editors of the Boston Bar Journal. A graduate of Yale Law School, Paul served as an Advisor to the American Law Institute on the inaugural Restatement: Employment Law and as Co-Chair of the Labor & Employment Section of the Boston Bar Association.
Professional Background
A member of the National Employment Arbitration Panel, and the Mediation Panel of the American Arbitration Association, Paul Holtzman serves as a mediator, arbitrator and hearing officer in all matter of employment, business and civil rights disputes. With thirty plus years of litigation experience, Paul is able to assist parties in accurately assessing and negotiating resolutions of both individual and class or collective actions. He has mediated cases for United States District Court, Equal Employment Opportunity Commission (EEOC) and Massachusetts Commission Against Discrimination (MCAD).
Experience
Arbitrator/hearing officer and mediator as member of AAA panels and ADR panel of Boston Law Collaborative. Arbitration matters include hearings in Massachusetts and North Carolina on claims relating to non-competition agreements; wage disputes; discrimination; retaliation; and claims for severance pay pursuant to change of control agreements.
Mediated approximately 200 employment cases, including class actions raising complex wage and hour issues, federal and state court actions related to misclassification, overtime, off the clock work, dual jobs, commission disputes, prevailing wage and retaliation claims. Other topics include classification as independent contractor, claims under Family and Medical Leave Act (FMLA) and discrimination claims.
Served as mediator for United States District Court, Massachusetts Commission Against Discrimination (MCAD), and Equal Employment Opportunity Commission (EEOC).
