Estate Disputes
Mediation is a means of resolving disputes between consenting parties. This is especially important when family members are the disputants. All parties are brought together in a confidential, neutral setting. Through the guidance of the mediator, a trained and impartial party, issues are identified, information is gathered and resolutions are created. In mediation, the people involved make informed decisions and develop mutually acceptable agreements.
There is no right or wrong or assigning of blame in mediation sessions. The mediator is a professional who meets with the involved parties to examine the issues that are distinguished in terms of needs and interests. The mediator assists in resolving the dispute. The mediator will not make the decision as to which solution would be best. The mediator guides the parties allowing them to decide which options satisfy each party's issues fairly. A written agreement is then prepared.
